Eleanor Donaldson Seeks Court of Appeal Review Following Trial of the Facts Determination

Eleanor Donaldson has initiated formal legal proceedings to challenge the outcome of her recent trial of the facts, submitting an application for leave to appeal the judicial determination that established she had performed the acts underpinning all five charges brought against her. The legal challenge represents a direct response to the conclusions reached by the court following an examination of evidence earlier this year.

The Northern Ireland Courts Service confirmed on Thursday that an application seeking permission to appeal had been officially lodged by Eleanor Donaldson’s legal defense team. The case has now been placed before the Court of Appeal, where senior judges will be asked to review the legal foundation and procedural aspects of the findings made during the original courtroom proceedings.

The specific allegations considered during the court process involved five distinct charges, the majority of which centered on accusations that Eleanor Donaldson had assisted in the sexual offending perpetrated by her husband, Jeffrey Donaldson. In total, four of the five counts presented before the court alleged that she had actively aided and abetted his unlawful actions.

Her husband, Jeffrey Donaldson, is a prominent political figure in Northern Ireland who previously served as the leader of the Democratic Unionist Party (DUP). He was convicted following a parallel trial on 18 separate charges of sex abuse, concluding a major criminal prosecution regarding his past conduct.

The criminal convictions handed down against the former DUP leader involved severe historic offences, including one count of rape, committed against two female victims. The court heard that the offending took place when both of the victims were children, forming the basis of the comprehensive guilty verdicts returned against him at the conclusion of his trial.

Eleanor Donaldson was not subjected to a standard criminal trial alongside her husband because medical assessments determined that she was unfit to undergo conventional criminal proceedings. Due to concerns regarding her mental health, the justice system utilized an alternative statutory route specifically designed for defendants who are unable to participate fully in ordinary legal trials.

Under the judicial framework in Northern Ireland, a trial of the facts is instituted whenever a defendant is declared unfit to plead or stand trial by reason of medical or psychological conditions. The primary objective of this procedure is to establish an objective factual record while safeguarding the rights of an individual who cannot adequately instruct legal counsel or follow standard court processes.

In a trial of the facts, the court does not return a traditional criminal verdict of guilty or not guilty, nor does it establish standard criminal culpability. Instead, the legal inquiry is strictly limited to determining whether the prosecution has proven beyond reasonable doubt that the accused individual committed the physical acts alleged in the formal indictment.

The specialized hearing concerning Eleanor Donaldson took place at Newry Crown Court, running simultaneously with the full criminal trial of her husband across May and June. Over those two months, the court heard the evidence presented by the prosecution regarding the actions alleged against both individuals.

Because the proceedings were conducted under the trial of the facts mechanism rather than as a standard criminal trial, Eleanor Donaldson is legally exempt from custodial punishment. The presiding judge has no statutory power to impose a prison term on her, regardless of the findings that she performed the acts detailed in the five charges.

Instead of incarceration, the sentencing judge is restricted to a narrow set of statutory disposals prescribed by law for individuals who have undergone a trial of the facts. The available outcomes for Eleanor Donaldson are limited to either the imposition of a formal medical treatment order or the granting of an absolute discharge.

The trial judge from Newry Crown Court who oversaw the proceedings is scheduled to issue a definitive decision on her disposal in October. That upcoming hearing will formally resolve which legal measure will be applied to Eleanor Donaldson in light of the court's earlier findings regarding her actions.

Eleanor Donaldson’s decision to seek an appeal comes as Jeffrey Donaldson also prepares to challenge his own criminal convictions. A solicitor representing the former DUP leader has confirmed that he is appealing against all 18 of the sexual abuse convictions handed down against him at Newry Crown Court.

The dual legal challenges mean that both the full criminal verdicts against Jeffrey Donaldson and the findings reached in Eleanor Donaldson’s trial of the facts will be subjected to higher judicial review. Appellate judges will have to evaluate the merits of the arguments presented by both legal teams as the cases move forward.

With the Court of Appeal now tasked with reviewing the application for leave, the legal process surrounding the couple enters another critical stage. As the appellate jurisdiction prepares to consider the matter, attention will also turn to the Newry Crown Court in October, when the judge is expected to finalize Eleanor Donaldson’s legal disposal.
